Article 1 - Scope

These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") govern all relations between BELGRADE AIRPORT, with headquarters located in Belgrade, 11180 Belgrade 59, Register under number 21364568, and any Customers placing an Order on the website (hereinafter referred to as "the Store").
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") govern all relations between BELGRADE AIRPORT, with headquarters located in Belgrade, 11180 Belgrade 59, Register under number 21364568, and any Customers placing an Order on the website (hereinafter referred to as "the Store"). They may be modified at any time and without prior notice by BELGRADE AIRPORT, with it being stipulated that the applicable GTCS are those in force and online on the day of placing the Order. Any Order placed in the Store implies prior unconditional acceptance of these GTCS.
When placing the Order, Customers certify that they are a natural person of legal age, acting either on their own behalf or on behalf of a legal person they are duly authorized to represent. They acknowledge having the full legal capacity to make transactions under these GTCS.

Article 2 - Services offered by the store

The Services offered by the Store are:

  • The "Online parking space booking" Service in Appendix 1,
  • In the context of purchasing the above-mentioned services, Customers are deemed to have accepted all terms and conditions of sale set out in the applicable appendix(ices).

Article 3 - Terms of the "customer account"

When placing the first Order on the Store, any new Customer must create a “Customer Account” for which he is required to choose an identifier (consisting of his e-mail address) and a password of at least 8 alphanumeric characters - containing a lower-case character, upper case character, number and special character - in order to personalize its navigation.
At each new visit, the Customer authenticates himself thanks to the association of these two elements which constitutes proof of his identity. The Customer therefore undertakes to provide sincere and true information concerning him, when registering.
Passwords and identifiers are personal and confidential data that the Customer undertakes not to disclose. He is therefore solely responsible for their use. The recorded data constitutes proof of all transactions made by the Customer on the Store.
Any attempt to substitute the password or username of another Customer is strictly prohibited. BELGRADE AIRPORT reserves the right to automatically delete, without notice or compensation, the Customer's account in the event of non-compliance with these T & Cs, in particular in the event of fraudulent use.

Article 4 - Final validation of the order

Payment for products on our online store can be made in one of the following ways: By payment cards - VISA, Maestro or MasterCard that support online payment. Card payment process is established in cooperation with AllSecure doo and UniCredit Bank and performed by simply entering the payment card data, using a secure and certified method through AllSecure Paymet Gateway.



After entering the card data and confirming the payment, the bank authorizes the transaction, and thus the order is approved, and goes through the further process of preparation for delivery. The amount will be reserved on your card (account) and will not be available for another purpose.

If the payment is not completed, or the amount is not withdrawn from the account within 14 days of accepting your order, such order will be cancelled and deleted. After the expiration of the 14-day period, the money reserved in your account will be released and available for use again. Then, you can repeat the same order or make a new one and make related payment.

Check with the bank that issued your card if your card supports online payments.

When entering payment card data, confidential information is transmitted via the public network in a protected (encrypted) form using the SSL protocol, applying the most modern methods of tokenization of sensitive data, and in accordance with PCI-DSS standards. At no time is the payment card information available to the merchant.

3D Secure protection for all merchants and customers - AllSecure Payment Gateway uses the highest global standards of data protection and privacy. All merchants using the AllSecure Payment Gateway are automatically included in 3D-Secure protection, which guarantees customers the security of their purchase. Customer payment card numbers are not stored on the merchant's system and the registration itself is protected by SSL data encryption.

PCI DSS Standards - AllSecure Payment Gateway is constantly complying with all the requirements of card organizations in order to increase the level of security of merchants and customers. From 2005 until today, without interruption, the system has been certified as PCI-DSS Level 1, which is the highest standard in the industry. The PCI Data Security Standard (PCI-DSS) is a standard that defines the necessary security measures when processing, storing and transmitting sensitive card data. PCI Standards protect sensitive cardholder data during the entire payment process: from the moment of entering data at the merchant's point of sale, during communications between the merchant and relevant banks and card organizations, as well as the subsequent storage of this data.

The different stages of an Order are detailed throughout the Order process, in the Store. The Customer is informed of the characteristics and availability of the services offered directly on the Store.

They can be adapted by BELGRADE AIRPORT at any time to better meet the expectations of its Customers.

The contract is validly concluded because of the "double click" procedure, with the possibility of checking the details of the Order and its total price, in order to correct any errors, before confirming it to express final acceptance.

Once having read and accepted these T & Cs by checking the box "I validate the general conditions of sale and the confidentiality policy”, the Customer finalizes and definitively validates his Order.

The Customer then receives a summary of the information of his Order by an automatically generated confirmation email, as soon as the payment confirmation page is displayed.

The Customer is recommended to archive or print this confirmation email as well as the payment certificate.

Any new Order from the Customer is only accepted after full and regular payment by the Customer of the sums due in respect of his previous Orders.

Article 5 - price

"Statement on currency conversion - Please note that all payments will be effected in the Serbian currency – dinar (RSD). If the payment is made using foreign issuer payment cards, total amount of a transaction will be converted into bank settlement currency (EUR), according to the current exchange rate of the National Bank of Serbia. When crediting you payment card, the already converted amount will be converted into your local currency according to the exchange rate of bank card operators.”
All prices are given in RSD and include all taxes. They are liable to fluctuations and may be updated at any time. The invoiced prices are those in force on the day of confirming the Order.

Article 6 - Terms of payment

Any payment paid to BELGRADE AIRPORT account cannot be considered a deposit. For each advance payment BELGRADE AIRPORT will issue an advance payment invoice and after the service is rendered the Customer will receive the final invoice. The only authorized means of payment is the bank card, through a secure payment system. Only Visa and Mastercard cards are accepted when a Customer explicitly acknowledges having the rights of use.
Under no circumstances, nor even on the grounds of a complaint formulated the Customer may withhold all or part of the sums due, nor obtain any compensation. Payment collection proof is available on the “Customer Account”.
In the event that the payment turns out to be irregular, incomplete or non-existent, for any reason whatsoever, the sale of the service cannot take place.

Article 7 - withdrawal period

As per article 28 of the Consumer Protection Law (“Official Gazette of RoS no 44/2018- other law), Customers benefit from the 14-day right of withdrawal following Order confirmation, without any explanation of the reasons or cancellation fee payment, except for the costs of articles 34 and 35 of the Law.
To exercise this right to withdrawal, Customers may directly cancel their booking through the "Customer Account" or use right of withdrawal standard form or any other document that they can send to CUSTOMER SERVICES as long as the request unambiguously expresses their desire to cancel the Order.
In all cases, the cancellation document must at least include Customer surname, first name and the Order number.
In case of withdrawal, Customers are reimbursed the amount, within a maximum of 14 days from the date on which BELGRADE AIRPORT is informed of the Customer's decision to cancel the Order. Reimbursement is directly credited to the bank account connected to the card used when placing the Order.
Customer’s right to withdrawal expires as well with expiry of 14-day period.

In the case of a refund to a customer who has previously paid by one of the payment cards, partially or in full, and regardless of the reason for the refund, the refund is made exclusively through the same VISA, Maestro or MasterCard card used for payment. This means that our bank will, at our request, refund the funds to the cardholder's account.

Article 8 - Responsibility

BELGRADE AIRPORT shall not be held responsible in the event of the non-execution of its obligations due to Force Majeure, as defined by legal regulations. Likewise, it shall not be held liable for:
— Disruptions or failures inherent to using the Internet network that affect browsing in the Store,
— Malfunctions due to third-party software,
— Outside intrusion or the presence of computer viruses on the Customer's computer.

Article 10 - Final stipulations

BELGRADE AIRPORT archives Purchase Orders and invoices on a reliable, sustainable medium constituting a faithful copy thereof. Electronic records, kept in the IT systems under reasonable security conditions, are deemed proof of communication, Orders and payments made by the Customer.
These GTCS are subject to domestic regulations.
If one of the clauses or provisions in these GTCS is cancelled or declared invalid or illegal, such invalidity or illegality shall in no way affect the other clauses and provisions, which shall continue to apply.


Appendix 1: special terms and conditions of sale applicable to the online parking space booking service

Article 1 - Scope

Only Customers wishing to park a private car (motor vehicle, manufactured and designed for the transportation of people, which has at least four wheels, with a maximum of eight seats in addition to the driver's seat and for which the total laden weight permitted is less than 3.5 tons), can benefit from the online parking space booking Service in the Store (hereinafter referred to as the "Booking Service"), for which the maximum height complies with the limits set out in the table below:

Article 2 - Description of service

The "Booking Service" sold in the Store provides Customers with one (or more) parking space(s) in one of the car parks at BELGRADE AIRPORT (Garage) for a specific date, duration and time, limited to the number of spaces available when the Order is placed.
Unless specifically indicated by the Store, the accurate location/position of the space is not allocated, so Customers may park in the first available space.
The "Booking Service" is only for Customers who have created a "Customer Account" as per the terms and conditions set out in these GTCS. It offers the possibility to book a space, with no limited maximum parking duration (with a minimum of 8 hours).

A parking space may only be booked online at most 2 months (and at least 4 hours) prior to the actual vehicle parking time. When placing the Order, Customers have the possibility to provide the vehicle licence plate number to save time with automatic barrier opening, provided that the licence plate can be read correctly.

Article 3 - Terms and conditions of use

When Customers arrive at the car park entry terminal (at the scheduled time), they place the coupon they were sent when the Order was placed (also available to be downloaded from the "Customer Account" dashboard) in front of the scanning device. For it to be recognized, Customers must print the coupon out on paper or have it directly downloaded to their smart phone beforehand. If the registration number is provided beforehand, Customers must arrive in the corresponding vehicle. When leaving, if Customers have not exceeded the scheduled exit time, they place the coupon once again in front of the exit terminal scanning device to exit the car park. It shall no longer be possible to use the same coupon. BELGRADE AIRPORT recommends that our Customers take good care of their coupon, which, under all circumstances, is essential for accessing and exiting the car parks, especially in the event of poor legibility of the licence plate number initially provided upon placing the Order, or if arriving in a different vehicle. The issued coupon is strictly personal and confidential. It contains a bar code for which counterfeiting or reproduction is strictly prohibited. It may not be given or transferred to a third party. Customer is responsible for retaining the coupon until exiting the applicable car park. BELGRADE AIRPORT shall accept no liability in case the coupon is used by third-party or in case of fraudulent use. In the event of loss of or difficulty in scanning the coupon, Customers must call an "Agent" using the intercom system located at the car park entry and exit terminals. The Agent then checks Customers’ bookings in the databases before enabling them to access or exit the applicable car park. Beyond the time indicated in the booking, extra time is invoiced as per the following rates table, for which any portion started is due.



BELGRADE AIRPORT therefore recommends that our Customers leave enough time between their flight arrival time and their car park exit time. Under no circumstances may BELGRADE AIRPORT be held liable for extra time spent at the car park related to events outside the "Online Booking Service".

Article 4 - Modification - cancellation

Conditions are valid for all car parks.

Modification

It is possible to modify your order up to four hours before the arrival time at the car park (indicated on your booking): entry and/or exit times and dates, name of the holder and car licence plate number.

Cancellation

Beyond the legal right to withdrawal, BELGRADE AIRPORT allows our Customers to cancel their Orders up to 24 hours prior to the scheduled parking dates and times. To do so, Customers follow the same procedure as those in Clause 7 of the GTCS. Once this procedure has been followed, Customers are reimbursed 100% of the cost of the Order, within a maximum of 14 days from the date BELGRADE AIRPORT is informed of the cancellation request (due to bank transfer cost).
Reimbursement is directly credited to the bank account connected to the card used when placing the Order.

Article 5 - Final stipulations

The "Booking Service" only provides the right to park and not the right to vehicle security, surveillance or drop-off. BELGRADE AIRPORT shall accept no liability in the event of loss, damage or theft of Customers' personal belongings, as these are the sole and unique responsibility of Customers.
